General Data Protection Regulation
Processing personal data is usually forbidden unless the processing is specifically permitted by law or the data subject has given consent. Consent is only one of six legal bases listed in the General Data Protection Regulation (GDPR) for processing personal data. Contract, legal duties, the data subject's vital interests, public interest, and legitimate interest, as defined in Article 6(1) GDPR, are the others. The GDPR defines the essential conditions for the efficacy of valid legal consent in Article 7 and further specifies them in Recital 32. Freely granted, precise, informed, and unambiguous consent is required. It must be offered voluntarily in order to receive freely granted consent. The term "free" indicates that the data subject has made a legitimate decision. Any improper pressure or influence that could influence the outcome of that option invalidates the consent. As a result, the legislative text considers a certain imbalance between the controller and the data subject. For example, in an employer-employee relationship, the employee may be concerned that refusing to consent could jeopardize his employment, hence consent can only be a legal foundation for processing in a few limited circumstances. Furthermore, there is a so-called "coupling prohibition" or "prohibition of joining or tying." As a result, the performance of a contract cannot be made contingent on agreement to process additional personal data that isn't required for the fulfillment of the contract.
